1. Scope and agreement

These Terms of Use (“Terms”) govern access to and use of the Live Play Grow website and its articles, adventure finder, activities, printables, newsletters, and related features (collectively, the “Site”). In these Terms, “Live Play Grow,” “we,” “us,” and “our” refer to the operator of the Site.

Additional terms presented with a particular feature or download also apply to that feature. If additional terms conflict with these Terms, the additional terms control only for that feature.

2. Eligibility and adult responsibility

You must be at least 18 years old, or the age of legal majority where you live, to agree to these Terms. The Site is intended for adults, including parents, caregivers, and educators. Children may use activities and materials only with appropriate adult involvement and supervision.

If you use the Site on behalf of a school, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.

3. Informational content and safety

Our activities and recommendations are offered for general informational and inspirational purposes. You are responsible for deciding whether an activity, material, location, or product is appropriate for your family or group. Consider age, ability, allergies, medical needs, weather, equipment, choking hazards, water, heat, tools, travel conditions, and other circumstances before participating.

Provide suitable adult supervision, follow product instructions and posted rules, and stop any activity that appears unsafe. Site content is not a substitute for your judgment, qualified in-person instruction, or medical, health, safety, legal, or other professional advice. The adventure finder is not an emergency, navigation, or safety service.

4. Assumption of activity risk

Hands-on projects, outdoor recreation, travel, and visits to third-party places can involve inherent and unexpected risks, including illness, allergic reaction, property damage, personal injury, or death. To the fullest extent permitted by applicable law, you knowingly and voluntarily assume the risks of activities and outings you choose to undertake in reliance on the Site. This provision does not waive any right or liability that cannot legally be waived.

5. Places and changing information

Destinations, events, businesses, trails, and other third-party places can change without notice. Hours, prices, availability, accessibility, conditions, rules, and other details may be incomplete or out of date. Verify important information directly with the place or provider before visiting. Inclusion on the Site is not a guarantee or certification of safety, accessibility, availability, or quality.

6. Site license and ownership

Subject to these Terms, Live Play Grow grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial purposes. All rights not expressly granted are reserved.

The Site and its original text, photographs, graphics, designs, downloads, software, branding, and other content are owned by Live Play Grow or used with permission and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of any content, trademark, or other proprietary right.

7. Printables and permitted use

Unless a download says otherwise, Live Play Grow grants you a limited, revocable, nonexclusive, nontransferable license to download and print its printables for personal, household, or single-classroom noncommercial use.

You may not sell or commercially exploit the materials; redistribute the digital files; publish or upload them elsewhere; remove ownership or attribution notices; or represent them as your own. Contact us before using any material outside this permission.

8. Acceptable use

You agree not to:

• violate applicable law or another person’s rights;
• copy, reproduce, distribute, sell, license, or commercially exploit Site content except as expressly permitted;
• interfere with the Site’s operation or security, attempt unauthorized access, or introduce malicious code;
• use automated means to overwhelm, extract from, or scrape the Site without prior written permission; or
• misrepresent your identity, affiliation, or the source of Site content.

Ordinary search-engine indexing and sharing links to public Site pages are permitted.

9. Affiliate and third-party services

Some pages contain affiliate links. If you make a purchase through one, Live Play Grow may receive a commission at no additional cost to you. We identify affiliate relationships near the relevant recommendations.

The Site may also display information from or link to websites and services operated by others. Links are provided for convenience and do not make us responsible for a third party’s content, availability, accuracy, terms, privacy practices, products, or services. Your dealings with a third party are solely between you and that third party.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and all content made available through it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and availability.

We do not warrant that the Site will always be complete, current, uninterrupted, error-free, secure, or free of harmful components, or that it will be suitable for every person or situation. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by applicable law, Live Play Grow and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Site, its content, activities, downloads, third-party services, or recommended places or products, even if advised that such damages were possible.

To the fullest extent permitted by applicable law, the aggregate liability of Live Play Grow and those parties for all claims arising from or related to the Site will not exceed the greater of $100 or the amount you paid directly to Live Play Grow for the feature giving rise to the claim during the twelve months before the claim arose.

These limitations do not apply to liability for gross negligence, fraud, or intentional, willful, malicious, or reckless misconduct, or to any liability or consumer right that applicable law does not allow to be excluded or limited. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

12. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Live Play Grow and its owners, employees, contractors, and service providers from claims, liabilities, losses, judgments, costs, and reasonable legal fees arising from your unlawful misuse of the Site, your material breach of these Terms, or your violation of another person’s rights. This section does not require you to indemnify any party for conduct for which indemnification is prohibited by law.

13. Suspension and termination

We may restrict or terminate access to any part of the Site when reasonably necessary to protect the Site or others, comply with law, or address a violation of these Terms. The provisions concerning ownership, permitted use, warranties, liability, indemnification, and general terms will survive termination to the extent their nature requires.

14. Privacy

Our Privacy Policy explains how the Site handles newsletter information, analytics, and privacy choices.

15. Changes to the Site or these Terms

We may modify, suspend, or discontinue any part of the Site. We may also update these Terms from time to time. If a change is material, we will make reasonable efforts to provide notice on the Site before the change takes effect. The effective date above will identify the current version. Your continued use of the Site after revised Terms take effect means you accept the revised Terms.

16. General terms

These Terms and the Privacy Policy constitute the entire agreement between you and Live Play Grow concerning use of the Site. If we delay or fail to enforce a provision, that does not waive our right to enforce it later. If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

You may not assign your rights or obligations under these Terms without our prior written consent. Section headings are provided only for convenience and do not affect interpretation. Nothing in these Terms limits mandatory consumer protections that apply to you.
